Service Level Agreement (SLA)

This Service Level Agreement ("SLA") forms part of the agreement between MG SOFT SOLUTIONS ("Service Provider", "We", "Our", "Us") and the customer ("School", "Institution", "Customer", "You") using MG SCHOOL SOFT.

This SLA describes the level of service and support that MG SOFT SOLUTIONS aims to provide. Unless a separate written agreement states otherwise, this SLA applies to all standard subscriptions.

1. Purpose

The purpose of this SLA is to define:

  • Service availability
  • Customer support
  • Response times
  • Maintenance
  • Incident handling
  • Customer responsibilities
  • Service limitations
2. Services Covered

This SLA applies to:

  • MG SCHOOL SOFT Web Application
  • Android Mobile Application
  • Parent Mobile Application
  • Teacher Mobile Application
  • Cloud Hosting (if provided by MG SOFT SOLUTIONS)
  • Technical Support
  • Software Updates
  • Bug Fixes
3. Service Availability

We strive to maintain 99.5% monthly uptime for cloud-hosted services, excluding scheduled maintenance, emergency maintenance, ISP failures, power outages, third-party outages, force majeure events, and customer network/device issues.

4. Support Hours

Monday to Saturday, 9:30 AM to 6:30 PM (Indian Standard Time). Support may not be available on Sundays or public holidays, except for critical issues.

5. Support Channels

Email, Telephone, WhatsApp (if officially provided), Remote desktop support, Customer support portal (if available).

6. Incident Priority Levels

Priority 1 – Critical: Complete system outage, unable to log in, database failure, data corruption, security incident. Response: Within 4 business hours.

Priority 2 – High: Major feature not working, fee collection unavailable, attendance/exam module unavailable, mobile app issues. Response: Within 1 business day.

Priority 3 – Medium: Individual user issues, printing problems, report generation, minor errors. Response: Within 2 business days.

Priority 4 – Low: Feature requests, cosmetic issues, UI improvements, general questions, training. Response: Within 3 business days.

7. Resolution Times

Response times indicate when we aim to acknowledge and begin investigating. Resolution depends on complexity, third-party dependencies, and customer cooperation.

8. Scheduled Maintenance

Customers will receive advance notice. Maintenance planned during periods to minimize disruption.

9. Emergency Maintenance

May be performed without prior notice for security vulnerabilities, system failures, data integrity issues, infrastructure failures.

10. Software Updates

Security updates, bug fixes, performance improvements, new features, regulatory compliance updates. May be deployed automatically for cloud-hosted services.

11. Customer Responsibilities

  • Using software per Terms & Conditions
12. Services Not Covered

Customer hardware failures, internet connectivity, power failures, third-party software issues, unauthorized modifications, user training beyond scope, custom development, incorrect data entry.

13. Backup and Disaster Recovery

We may maintain backups for business continuity. Restoration of all data cannot be guaranteed. Customers encouraged to maintain independent copies.

14. Service Suspension

Services may be suspended for unpaid fees, illegal activities, unauthorized access, security threats, or legal requirements.

15. Force Majeure

Not responsible for delays/failures from natural disasters, war, terrorism, government actions, internet outages, power failures, cyberattacks, pandemics, labor disputes.

16. Limitation of Service

No guarantee of uninterrupted or error-free operation. Temporary interruptions may occur.

17. Changes to SLA

Updated versions effective upon publication or notification. Continued use constitutes acceptance.

18. Governing Law

Laws of India. Exclusive jurisdiction of courts in Hyderabad, Telangana, India.

Security Practices

Committed to protecting security, confidentiality, integrity, and availability of customer data.

1. Security Commitment

Safeguard against unauthorized access, misuse, disclosure, alteration, destruction.

2. Secure Data Transmission

Protected using industry-standard encryption (HTTPS/TLS).

3. Password Security

Keep passwords confidential, use strong/unique passwords, don't share, manage permissions, report unauthorized access.

4. Access Control

Restricted based on user roles and permissions. Authorized personnel may access under strict confidentiality.

5. Data Backup

Periodic backups for disaster recovery. Customers encouraged to maintain independent copies.

6. Infrastructure Security

Firewalls, malware protection, OS updates, security patches, access controls, monitoring, secure server configuration.

7. Software Updates

Bug fixes, performance improvements, security vulnerabilities, functionality enhancements, compatibility.

8. Monitoring and Logging

Login history, IP addresses, device/browser info, error logs, audit logs, system events.

9. Employee Confidentiality

Employees/contractors subject to confidentiality obligations.

10. Customer Responsibilities

Secure passwords, accurate permissions, remove inactive accounts, protect devices, updated browsers/OS, secure internet.

11. Incident Response

Will investigate and notify affected customers within reasonable time after confirming incident.

12. Third-Party Services

Cloud hosting, SMS gateways, payment gateways, email services, WhatsApp API. Each has own security policies.

13. Business Continuity

Backups, monitoring, maintenance, disaster recovery. Uninterrupted availability not guaranteed.

14. Responsible Disclosure

Report vulnerabilities responsibly. Do not exploit or access without authorization.

15. Changes

Updated versions effective when published.

Refund & Cancellation Policy

Effective Date: 01/01/2026

All payments are final and non-refundable except where required by law.

1. General Policy

Costs incurred immediately upon project commencement are non-recoverable.

2. No Refund Policy

No refunds for subscription fees, development charges, domain registration, hosting, SSL, customization, training, installation, renewal, maintenance, AMC, support, upgrades.

3. Reasons

Domain registration, hosting/server costs, deployment, development, implementation, accounts/databases, security, licensing, employee costs, third-party charges are non-recoverable.

4. Subscription Cancellation

Written notice required. Stops future renewals. No refund for fees already paid. Outstanding dues remain payable.

5. Non-Payment

May suspend access, restrict login, suspend support, disable hosting/mobile services, terminate account after notice.

6. Domain Registration

Registration and renewal fees non-refundable. Transfer subject to registrar policies.

7. Hosting Services

Hosting, server setup, backup, SSL charges non-refundable (procured from third-party providers).

8. Website/Software Development

Development work begins after confirmation. All development charges non-refundable regardless of completion stage.

9. Customization

Customization charges final and non-refundable.

10. Third-Party Services

SMS, WhatsApp, payment, email, hosting, domain charges governed by provider policies, non-refundable by MG SOFT.

11. Data Export

Customers responsible for downloading data before termination. Data may be deleted after retention period.

12. Exceptions

Exceptions solely at MG SOFT discretion or required by law.

13. Changes

Updated versions effective upon publication.

14. Governing Law

Laws of India. Exclusive jurisdiction of courts in Hyderabad, Telangana, India.

Data Processing Agreement (DPA)

Effective Date: 01/01/2026

Governs processing of personal data through MG SCHOOL SOFT.

1. Purpose

Define responsibilities of both parties regarding personal data processing.

2. Definitions

Personal Data: student/parent/teacher/employee/visitor info, financial, attendance, exam, medical, photos, documents, contact, ID numbers. Processing: collecting, recording, storing, organizing, modifying, retrieving, using, sharing, deleting, destroying.

3. Roles

Data Controller (School): Determines what/why/how data is collected, used, accessed, retained, deleted. Solely responsible for privacy/data protection laws.

Data Processor (MG SOFT): Processes data to provide software, store data, enable access, perform backups, provide support, maintain functionality, improve security, perform updates. Does not determine purpose/means.

4. Categories of Data

Student/parent/staff/employee records, attendance, timetables, fees, payroll, exam results, library, transport, hostel, certificates, images, documents, identity, contact info.

5. Data Subjects

Students, parents, guardians, teachers, employees, administrators, visitors, alumni, vendors, contractors.

6. Instructions

Process data only per School instructions, as necessary for services, or required by law.

7. Confidentiality

Employees/contractors bound by confidentiality, access only when necessary.

8. Security Measures

Authentication, password protection, encryption, role-based access, activity logging, server security, firewalls, malware protection, updates, backups.

9. Customer Responsibilities

Legal right to collect/process, obtain consents, manage permissions, strong passwords, updated contact info, verify data accuracy, respond to data requests, comply with privacy laws.

10. Sub-processors

Cloud hosting, SMS, email, payment, WhatsApp, backup, monitoring/security providers under contractual obligations.

11. International Transfers

Appropriate safeguards in place where required by law.

12. Data Breach

Notify School without undue delay after confirming incident.

13. Assistance

Assist School in responding to lawful requests (access, correction, deletion, restriction).

14. Retention/Deletion

Retained for service agreement duration. Upon termination, School may request return/deletion within specified period. After period, MG SOFT may securely delete.

15. Audit Rights

School may request information demonstrating compliance, conducted without compromising security/confidentiality.

16. Liability

School acknowledges: solely responsible for data legality, MG SOFT does not verify, not responsible for claims from School's data management.

17. Compliance

Comply with data protection/privacy laws including Digital Personal Data Protection Act, 2023.

18. Survival

Confidentiality, security, liability, data protection obligations continue after termination.

19. Governing Law

Laws of India. Exclusive jurisdiction of courts in Hyderabad, Telangana, India.

Terms & Conditions

Govern use of MG SCHOOL SOFT provided by MG SOFT SOLUTIONS.

1. About Service

Cloud-based/on-premise School Management Software. We provide platform, hosting, maintenance, updates, support. Not involved in school administration/operations.

2. Acceptance

By creating account, signing agreement, purchasing, or using, you agree to be legally bound.

3. Eligibility

Authorized educational institutions, schools, colleges, coaching centers with legal authority to enter binding agreement.

4. Customer Responsibilities

Accurate information, protect credentials, manage accounts/permissions, comply with laws, obtain consents, maintain backups, prevent unauthorized access.

5. Data Ownership

All data belongs to respective School. MG SOFT claims no ownership of student/parent/staff records, fees, exams, attendance, images, documents, reports, financial records, certificates.

6. Software Ownership

Software (source code, UI, databases, designs, logos, trademarks, docs, APIs, IP) owned exclusively by MG SOFT. Customers receive limited, non-exclusive, non-transferable, revocable license during subscription.

7. License Restrictions

Shall not: copy, reverse engineer, modify, decompile, sell, lease, rent, distribute, transfer license, remove copyright, attempt unauthorized access, create competing software.

8. Acceptable Use

Must not be used for: fraud, fake admissions, forged certificates, identity theft, financial fraud, harassment, defamation, malware, cybercrime, unauthorized access, money laundering, terrorism, illegal activities. Immediate suspension if detected.

9. Subscription/Payment

Pay all fees, setup, customization, renewal, taxes on or before due date. Failure may result in suspension/termination. Taxes customer responsibility unless stated.

10. Late Payments

May suspend without notice, restrict access, additional late fees/interest, data inaccessible until dues cleared.

11. Suspension

May suspend if: unpaid fees, illegal use, unauthorized access, security threats, breach of terms, required maintenance.

12. Termination

Per applicable agreement. Upon termination: access disabled, data retained per policy, outstanding payments payable, IP remains with MG SOFT.

13. Technical Support

Business hours unless agreed. Includes: troubleshooting, bug fixes, technical guidance, basic usage. Does not include: third-party issues, hardware failures, internet issues, unauthorized modifications, training beyond scope.

14. Updates

May release updates, bug fixes, security patches, features at discretion. Certain upgrades/customizations may incur charges.

15. Data Backup

May perform backups for operations. Customers responsible for own copies. No guarantee of recovery.

16. Confidentiality

Both parties keep proprietary/technical/commercial/business information confidential except required by law.

17. Disclaimer

Provided "as is" and "as available". Disclaim all warranties. No guarantee of uninterrupted/error-free/virus-free operation.

18. Limitation of Liability

Not liable for indirect, incidental, consequential, special, punitive, exemplary damages including loss of profits/revenue/business/goodwill/data. Total liability not exceed subscription fees paid in preceding 12 months.

19. Indemnification

Customer indemnifies MG SOFT from claims/damages/liabilities/costs from: uploaded data, law violations, misuse, IP infringement, claims by students/parents/employees/third parties.

20. Force Majeure

Not liable for delays/failures from natural disasters, war, terrorism, strikes, pandemics, power failures, internet outages, cyberattacks, government actions.

21. Governing Law

Laws of India. Exclusive jurisdiction of courts in Hyderabad, Telangana, India.

22. Changes

May modify at any time. Updated Terms effective upon publication or notification. Continued use constitutes acceptance.

Privacy Policy

School Management Software. We provide platform and technical services. Do not own/create/verify/control information entered by schools.

2. Data Ownership

All data belongs to respective school. MG SOFT claims no ownership of student/parent/teacher/employee info, attendance, exams, fees, certificates, payroll, academic records, images, documents, reports, financial records.

3. Responsibility for Data

School responsible for: accuracy, legality, permission to collect/upload, updating/deleting, compliance with laws. Company does not verify/validate.

4. Software Provider

MG SOFT provides: platform, hosting, maintenance, support, updates. Not involved in school operations.

5. Personal Information

May store: name, mobile, email, address, DOB, gender, Aadhaar (if entered), student/employee ID, parent details, academic records, attendance, fees, images, documents. Entered solely by school.

6. Automatic Collection

Login history, device/browser info, IP, OS, usage/error/security logs, session details. For security/maintenance.

7. Data Security

Reasonable administrative/technical/organizational security measures. No online service can guarantee absolute security.

8. Confidentiality

Employees access only when necessary for: technical issues, backups, support, performance improvement.

9. Data Sharing

Do not sell data. May disclose only: per school instruction, required by law, to trusted providers under confidentiality, to protect rights/safety/prevent fraud.

10. Third-Party Services

Cloud hosting, SMS, WhatsApp, payment, email, Google, Firebase, Maps. Each has own privacy policies.

11. Data Backup

May maintain backups for disaster recovery. Schools responsible for own copies where appropriate.

12. Data Retention

Until: school deletes, contract ends, legal requirements require longer, school requests deletion subject to contractual/legal obligations.

13. Children's Information

Contains student/minor info entered by authorized personnel. School responsible for required permissions/consents.

14. User Accounts

Schools responsible for: password confidentiality, managing accounts, assigning permissions, monitoring activity, reporting unauthorized access.

15. Illegal Activities

Prohibits: fraud, identity theft, forged certificates, fake admissions, money laundering, harassment, surveillance, cybercrime, illegal content, unlawful activities. Schools solely responsible.

16. Disclaimer

MG SOFT is only software provider. Not responsible for: incorrect data, fake records/certificates, illegal fees, academic/administrative decisions, violations, misuse.

17. Limitation of Liability

Not liable for indirect, incidental, consequential, special, exemplary, punitive damages including loss of data/profits/business/goodwill. Total liability not exceed amount paid in preceding 12 months unless required by law.

18. Compliance

Schools responsible for complying with all applicable laws/regulations/educational requirements for data collection/storage/processing.

19. Changes

May update from time to time. Continued use after publication constitutes acceptance.
